Mr. Smits has extensive experience in representing creditors in bankruptcy court. He has achieved outstanding results for his clients in connection with various types of matters including the following: prosecuting non-dischargeability actions against debtors seeking to avoid court judgments; defending creditors against preference actions; obtaining relief from the automatic bankruptcy stay permitting the creditor to proceed to take certain actions against the debtor, including foreclosure on real property; defending against adversary proceedings by the debtor against the creditor; evaluating the debtor's Chapter 11 plan of reorganization and the treatment of the creditor's claim under the proposed plan; challenging a proposed Chapter 11 plan of reorganization that unfairly and unjustly treats a creditor's claim; and a creditor's purchase of the debtor's assets in the bankruptcy proceeding.
